Terms of Service

These Terms of Service (“Terms”) govern access to and use of Pharos (the “Service”), operated by [Legal entity name], [Registered address], Greece (“we”, “us”). By creating an account or using the Service, the organisation you represent (“Customer”, “you”) agrees to these Terms, the Acceptable Use Policy and the Data Processing Agreement.

1. Business use only

1.1 The Service is offered only to businesses and other organisations acting in a professional capacity. It is not offered to consumers.

1.2 The person accepting these Terms confirms that they are authorised to bind the Customer, and that the company details provided (legal name, country and, where applicable, VAT ID) are accurate.

2. Verification levels

2.1 Access depends on the Customer’s verification level:

  • L0 — verified email: account and billing only, no searches.
  • L1 — active paid subscription, accepted terms and company details: infrastructure investigations (“Tier A”).
  • L2 — business verification, a named responsible person, multi-factor authentication, a signed AUP addendum and manual review: person searches (“Tier B”), when that feature becomes available.

2.2 Person searches are not available at launch. When introduced, they will be available only to L2-verified Customers with a declared purpose and legal basis. We may refuse or revoke L2 status at any time.

3. The Service

3.1 The Service runs a curated set of tools against public sources, keeps the raw output as evidence with its provenance (SHA-256 hash, source, tool version and UTC timestamp), correlates findings and produces reports.

3.2 Every investigation records a purpose declared by the Customer. The purpose is shown on reports and kept in our audit log.

3.3 We may add, change or remove sources, for example when a source’s terms, licence or reliability changes. Results depend on third-party public data, which may be incomplete, outdated or wrong.

4. Plans, trial, credits and payment

4.1 There is no free tier. The trial is paid and covers infrastructure (Tier A) investigations only.

4.2 Plans include a number of credits. When a job starts, the estimated maximum cost is reserved; when it ends, the unused part is refunded, including for tools that failed. Credit costs per source are shown in the app before a job is confirmed.

4.3 Plan credits are granted per billing period and expire as described at checkout. Credits have no cash value and are not transferable.

4.4 Prices are in EUR and exclude VAT unless stated otherwise. Payments are handled by our payment provider. If a payment is disputed, we may pause new jobs until the dispute is reviewed.

5. Customer obligations

5.1 You must use the Service lawfully, in line with the Acceptable Use Policy, and only for the purpose you declare.

5.2 Where investigation data includes personal data, you are the controller and are responsible for having a lawful basis, for any balancing test, and for answering data-subject requests. We act as your processor under the DPA.

5.3 You are responsible for the actions of your users, for keeping credentials secure and for enabling MFA where required.

6. Evidence and retention

6.1 Evidence and reports are kept for the retention period of your plan. You can shorten it but not extend it beyond the plan maximum. Expired data is deleted automatically.

6.2 Backups are kept for at most 30 days. Deletions are re-applied after any restore.

7. Suspension and termination

7.1 We may restrict (disable person searches), suspend (block new jobs) or terminate an account where we reasonably suspect a breach of these Terms or the AUP, a legal risk, or abuse. Where practical, we will tell you the reason and give you a chance to respond.

7.2 You may cancel at any time from the billing portal. On termination, investigation data is deleted according to the DPA.

8. Warranties and liability

8.1 The Service is provided “as is”. We do not warrant that results are complete or accurate.

8.2 To the extent permitted by law, our total liability under these Terms is limited to the fees paid by you in the twelve months before the claim. [Liability cap and exclusions to be confirmed by counsel.] Nothing limits liability that cannot be limited by law.

9. Changes

We may update these Terms. We will give at least 30 days’ notice of material changes by email or in the app. The version date at the top shows the current version.

10. Governing law

These Terms are governed by the laws of Greece. The courts of Athens have exclusive jurisdiction, unless mandatory law provides otherwise. [To be confirmed by counsel.]
